Charges and Penalties for Specific Theft Crimes
State law places theft crimes into the following categories:
- Petty theft: Individuals who steal $500 or less can face charges for petty theft. Penalties for this offense can include a fine of up to $500 and 6 months of jail time.
- Grand larceny: For theft crimes involving more than $500 or involving an individual taking something directly from another person, authorities can charge the defendant with grand larceny. Penalties include one to five years in prison, a fine of up to $5,000, and a mandate to repay the victim for any losses incurred.
- Burglary: First degree burglary can carry up to 20 years in prison and $10,000 in fines.
- Robbery: A robbery in the first degree means up to 10 years in prison.
When determining an appropriate sentence for theft crimes, courts also take into account the defendant's criminal history. Repeat theft offenders can face exponentially tougher penalties.
