Misdemeanor Crimes

Considered less serious than a felony, misdemeanors often result in jail time, fines, or both. Individuals convicted of misdemeanor offenses can face a maximum penalty of $500 in fines or up to one year in jail.

Under state law, misdemeanor crimes include:

  • First time possession of small amounts of marijuana
  • A first time DWI
  • Minor theft crimes, trespassing and many others.

A prior criminal record for the same crime will lead elevating the charges to a felony offense in many cases.

Felony Crimes

Felony offenses carry harsher penalties than misdemeanors, including very expensive fines and lengthy prison terms. While some felonies involve violent crimes, not all felony offenses include the element of force or violence. In addition, some felonies fall under the 85 percent rule, which states that individuals must serve at least 85% of their sentence before becoming eligible for early release.
