DUIs for those holding a commercial driver’s license are different than a regular license, with the BAC at a lower level of 0.04% BAC. If your BAC is higher than 0.04, you may be disqualified from holding a CDL. If you are convicted of a DUI, your CDL will be revoked for one year, with the same penalties if you refuse to take a breath or blood test. On your 2nd conviction of DUI, you are permanently disqualified. If you were transporting hazardous material at the time of the traffic stop, the minimum disqualification is 3 years.

You have 15 days to request a hearing regarding revocation of your CDL, but you will not be issued a CDL at the time of the hearing, with the only option being a “modified” non-commercial license. You will not be allowed to obtain a CDL work permit or hardship license.
